Abstract

MORA BASTIDAS, Freddy Alberto. Contributions to an uncertain reform for the Organic Labor Law in Venezuela. Gaceta Laboral, Dec. 2009, vol.15, no.3, p.36-52. ISSN 1315-8597.

The Organic Labor Law (Ley Orgánica del Trabajo-LOT) is the legal instrument that regulates relations between workers and employers in matters of individual and collective labor rights. Since it came into effect in 1990 until the date this article was published, 19 years have gone by in which the legal regulation has remained stagnant as a consequence of the vertiginous changes produced in business organization activities. The objective of this legal-dogmatic study of a documentary nature is to examine the LOT to review the existing contradictions and lacunas, as well as propose some aspects that could be incorporated were it to be reformed. Conclusions are that a complete, exhaustive revision of Law is indispensable to adapt this legal instrument to the constitutional and social changes that have taken place in the recent years.

Keywords: Organic Labor Law; Labor Law; reform of the Organic Labor Law.
