Abstract

ANEZ CASTILLO, María Alejandra. The Evidence Validation System in Venezuelan Labor Proceedings. Gaceta Laboral, Apr. 2009, vol.15, no.1, p.56-86. ISSN 1315-8597.

The norms that regulate the validation of evidence in Venezuelan labor proceedings were analyzed to determine the scope and limits of the labor judge. The research was of a descriptive, documentary, observational and non-experimental type, based on verdicts issued by the Social Cassation Court of the Supreme Court of Justice. Results indicated that healthy criticism as a system for the validation of evidence adopted by the legislator, constitutes an adaptation of Venezuelan judicial ordinance to modern conceptions, in which the judge in this evaluative activity, must use reason and logic, psychology as well as other scientific and technical knowledge, which facilitate his task of reconstructing past events and examining the evidence as a whole, to reason out and motivate his decisions, so that he can exercise legal control of the sentence. Conclusions were that the success of this system depends on the preparation and training of competent and capable judges for the administration of justice.

Keywords: Evidence; validation of evidence; healthy criticism; judicial doctrine; training of judges.
